These terms of sale are concluded on the one hand by the company Véritable SAS hereinafter called "Véritable SAS" and on the other hand, by any natural or legal person wishing to make a purchase via the website of Véritable SAS called here - after "the buyer" or "the customer".
These conditions of sale are intended to define the contractual relations between Véritable SAS and the buyer and the conditions applicable to any purchase made through the Véritable SAS merchant site, whether the buyer is professional or consumer. The acquisition of a good or a service through this site implies an unconditional acceptance by the buyer of these conditions of sale.
These conditions of sale will prevail over any other general or specific conditions not expressly approved by Véritable SAS. Véritable SAS reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.
During special operations with a merchant partner, if payment has not been made on the Véritable SAS website, the general conditions of sale of said partner will prevail over the General Conditions of Sale of the Véritable SAS website.
2. Characteristics of the goods and services offered
The products and services offered are those listed in the catalog published on the Véritable SAS website. These products and services are offered while stocks last. Each product is accompanied by a description established by the creator.
The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the product offered, in particular with regard to colors, textures and reflections.
Orders can be sent to Véritable SAS via internet (online store)
The buyer, who wishes to buy a product on the online store must:
- place the product he wishes to buy in his basket then validate his shopping basket.
- complete the identification form on which he will indicate all the contact details requested.
- confirm your order after checking it.
- make the payment under the conditions provided.
- confirm the order and payment.
The confirmation of the order implies acceptance of these conditions of sale, the acknowledgment of having perfect knowledge of it and the waiver of availing oneself of its own conditions of purchase or other conditions. All the data provided and the confirmation recorded will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions. The seller will send confirmation of the recorded order by email.
The validated order is only considered effective when the bank payment centers concerned have given their agreement. If the said centers refuse, the order is automatically canceled.
The prices displayed on the website are indicated in the currency of the country and are displayed according to the customer's IP address.
- France and European Union: The prices are indicated all taxes included.
- Outside the European Union and DOM-TOM: The prices are indicated without Taxes. These prices must be understood as "delivered right unpaid" (or DDU "Delivery Duty Unpaid").
Véritable SAS reserves the right to modify its prices at any time, it being understood that the price appearing on the day of the order will be the only one applicable to the buyer. The prices indicated include the order processing costs.
5. Custom duties and taxes
All orders placed on the Véritable SAS website to a country outside the European Union may be subject to taxes and customs duties which are imposed in the country of destination.
These customs duties and any taxes related to the delivery of an item are the responsibility of the customer and are their responsibility. Véritable SAS is not required to check and inform its customers of applicable customs duties and taxes. It is up to the customer himself to inquire with the competent authorities of his country.
The customer's refusal to pay customs fees results in the cancellation of the order and its refund. Transport and customs clearance costs to recall the order will be deducted from the amount refunded.
6. Payment terms
The amount is due when ordering.

7. Delivery terms
Deliveries are made to the address indicated when ordering which can only be in the agreed geographical area. Véritable SAS cannot be held responsible for any errors in customer input and the consequences thereof (for example errors or delays in delivery). In this context, the costs incurred for the return of the order would be borne by the customer.
In case of visible deterioration of the package, the customer has the option to refuse delivery.
In the event of damage during transport, the reasoned protest must be made to the transporter and Véritable SAS within three days of delivery. In the event of a dispute, the investigation may last up to twenty-one (21) working days.
All complaints relating to a defect in the goods delivered, an inaccuracy in the quantities or their incorrect reference must be transmitted to Véritable SAS within 48 hours of receipt of the package, failing which the right to claim will cease to be acquired.
8. Transfert of risks
Delivery is deemed to have been effected by the provision by the carrier of the goods ordered from the customer. It is materialized by the signature of the delivery slip by the customer.
The product (s) ordered travels at the risk of the sender; in the event of damage to the customer, it is therefore up to make all the necessary observations to the transporter during delivery, and at the same time inform Véritable customer service.
9. Delivery time
Processing time after validation of the order: 24 to 72 hours (working days)
Orders are considered validated upon receipt of payment.
- Delivery time for France: 2 to 3 working days in Colissimo,
- Delivery time for the European Union, Switzerland and the French overseas departments and territories: 4 to 5 working days.
- International delivery time (outside the EU): 6 to 15 working days.
Delivery times are given for information only; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.
The customer will be able to track his package using the tracking number which will be communicated to him by email when the order is sent.
In the event of delivery outside France, Véritable SAS cannot be held responsible for blocking by customs in the country of destination. No compensation can be requested from the sender in the event of seizure or blocking.
10. Delivery time for Pre-orders
We offer you the possibility of purchasing certain items currently out of stock by pre-order.
A pre-order is only taken into account once paid in full, when paying for your order. It may take a few weeks for the product to be available and sent to you. In all cases, we endeavor to give as much information as possible about the dates of availability. The delivery times for pre-orders are given for information only.
If your order contains a pre-ordered item as well as items already available, you will receive the whole once the pre-ordered item is available. We recommend that you order the items in stock separately.
11. Delivery costs
Shipping costs are invoiced in addition to the sale price of the products and are defined according to the amount of the order, the country of delivery, the mode of transport chosen by the customer, and the weight and volume of the items to be delivered.
This amount will be calculated automatically before the validation of your order, after having communicated your delivery address.
12. Right of withdrawal and return
In accordance with articles L121-21 et seq of the Consumer Code, the customer has a withdrawal period of fourteen (14) clear days from the date of receipt of his order.
The customer must, before any product return, contact Véritable SAS by email to learn about the return procedure and in parallel make a return request on the Véritable® e-commerce site. The exercise of the right of withdrawal can only be done in writing. The burden of proof of the exercise of the right of withdrawal lies with the customer, it will therefore be necessary to check the acknowledgment of receipt by the company Véritable®.
The return costs are the responsibility of the customer except in the event of an anomaly noted on the product received, not resulting from the poor conditions of transport.
In the event that the customer is led to refuse delivery of his package, the shipping costs cannot be reimbursed.
Any reimbursement in respect of the client will be made within thirty (30) days of the exercise of this right.
Within this period, the customer will have the choice of requesting either the reimbursement of the sums paid, or the exchange of the product.
When the right of withdrawal is exercised for one (or more) goods, Véritable® is obliged to reimburse the customer for all the sums paid, including the initial delivery costs, without undue delay and at the latest within fourteen (14) days from the date on which Véritable® is informed of the customer's decision to withdraw. Véritable® may defer the reimbursement until recovery of the goods or until the customer has provided proof of the shipment of these goods. The reimbursement will be made by Véritable ® using the same means of payment as that used by the client for the initial transaction.
This right of return can only be accepted for products in their original state and complete (packaging, accessories, instructions ...), without trace of use. Products returned and incomplete, damaged, damaged or soiled by the customer will not be reimbursed in full.
Limits to the right to reimbursement:
The customer may be held liable by Véritable® in the event of:
- deterioration of goods resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of these goods
- any damage caused to the product upon receipt of the goods by the customer and until their return to Véritable®
- the incomplete return of the good and its accessories without its packaging, its instructions for use, its documentation.
In such cases, the sum which may be withheld from the reimbursement of the product or requested from the customer may amount to:
- 100% of the price of the good for a damaged or used product
- 50% of the price of the good in the absence of return of accessories or consumables
Véritable® Garden Warranty
Véritable® grants the customer a free national guarantee which takes effect on the delivery date.
The product is guaranteed if accompanied by its purchase invoice.
The customer has a period of two years from the delivery of the goods to act as a legal guarantee of conformity, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code.
The warranty includes replacement of parts and labor.
Véritable® designs and markets living products. The natural germination rate of the seeds being between 65 to 95%, we cannot guarantee 100% germination. To ensure maximum satisfaction, we offer a "satisfied or exchanged" guarantee on our Lingots®.
The Lingot® warranty is valid for any purchase of a Genuine Lingot® on the www.veritable-potager.fr site or from one of our authorized resellers.
For any request for warranty coverage, please contact our Customer Service by sending us a photo of the Lingot® in your vegetable patch and indicating the species and date of planting. If your Lingot® is diagnosed as non-compliant, we will reimburse you in the form of a voucher to be used on www.veritable-potager.fr or we will send you a new Lingot® for free.
To be effective, the request for warranty coverage must be made between 20 and 30 days after the Lingot® planting date. Lingots® are guaranteed for 1 year from their date of purchase (date of the invoice as proof). In the case of a refund, you will receive a voucher for the value of your Lingot® by email within an indicative period of 10 days from the date of receipt of your compliant request.
"When the buyer requests from the seller, during the course of the guarantee granted to him during the acquisition or repair of a vegetable patch, a restoration covered by the guarantee, any period of immobilization comes to add to the duration of the remaining warranty. This period runs from the buyer's intervention request or the provision for repair of the goods in question, if this provision is subsequent to the intervention request."
Exclusions from the guarantee linked to the origin of the damage:
The Véritable® warranty does not apply in the event of accidental material damage, in particular it does not cover damage and breakdowns that have resulted:
- improper installation or improper use or maintenance of the product, including:
- improper use of the equipment or not respecting the instructions in the user manual;
- use of energy not in accordance with the manufacturer's instructions
- addition of fertilizer, soil or other products not recommended by Véritable ®
- addition of parts that do not comply with those recommended by the manufacturer;
- opening and modification of the content of the guaranteed product;
- lightning, flood, fire, overvoltage, shock, poor ventilation, falling, discoloration due to the action of light, burning, humidity, excessive heating or presence of insects or diseases;
- repairs carried out and / or any intervention on the equipment and / or opening of it by a person other than Véritable® customer service
- maintenance, repair or replacement of parts due to normal wear or a lack of maintenance
- corrosion, oxidation, poor connection or an external power supply problem. If, for example, a connection is made to a defective outlet, the warranty will not apply.
- If the device or Lingots are stored in an unsuitable space (humid room, too hot room, outdoor storage, etc.)
Guarantee exclusions linked to the nature of the damage (indirect damage):
The Véritable® warranty only covers the right to repair or replace the guaranteed product. Consequently, indirect damage resulting from breakdown or deterioration is not covered by the warranty.
- Damage and breakdowns falling under the specific exclusions provided for in the user manual
- Products guaranteed that the customer is not able to return or those returned without their accessories
The seller, in the online sales process, is only bound by an obligation of means; its responsibility could not be engaged for a damage resulting from the use of the Internet network such as loss of data, intrusion, virus, breakdown of the service, or other involuntary problems.
15. Personal data
In accordance with the law relating to data processing, files and freedoms of January 6, 1978, information of a nominative nature relating to the purchasers may be subject to automated processing. Véritable SAS reserves the right to collect information on buyers, including by using cookies. Users have the right to access and rectify data concerning them.
The automated processing of information, including the management of the e-mail addresses of users of the site has been the subject of a declaration to the CNIL registered under number 1922953.
Véritable SAS will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code. The computerized registers of Véritable SAS will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
17. Dispute resolution
These online sales conditions are subject to French law. In the event of litigation, competence is attributed to the competent courts of Paris, notwithstanding plurality of defendants or call in guarantee.
